A guide to these Terms

These Terms explain how you may use The Little London Vegan Platform, create an Account and purchase a Premium Membership. They also explain the rules which apply to Free Trials, payments, automatic renewal, cancellation, Third-Party Offers and shared plans.

You can browse certain content and features without creating an Account. An Account is required for personal features, and a paid Premium Membership is required to access the Premium Features identified on the Platform.

Eligible new members may receive a seven-day Free Trial. Only some Premium Features are available during the Free Trial. Third-Party Offers—including discount codes, promotional offers and other benefits made available by independent third parties—are reserved for paying members. Unless you cancel before the Free Trial ends, your selected monthly or annual Premium Membership will begin automatically and payment will be taken.

Premium Membership renews automatically until it is cancelled. You can cancel at any time, although cancellation will normally take effect at the end of your current billing period. We will remind you before a Free Trial converts into a paid Premium Membership and, if you have an annual Premium Membership, before it renews.

You have a statutory 14-day right to cancel when you first enter into a Premium Membership contract. Additional Cooling-off Periods may also apply when a Free Trial converts into a paid Premium Membership and when an annual Premium Membership renews. If paid Premium Features have already been supplied before you cancel, any refund may be reduced by the amount which we are entitled by law to retain or recover for the supply already made.

Third-Party Offers are made available by independent restaurants, venues, brands and other third parties. They may be subject to conditions and may be changed, suspended, withdrawn or unavailable. You should check the applicable conditions and, where appropriate, confirm availability with the relevant third party before booking, ordering, purchasing or travelling.

These Terms also explain the rules concerning Account security, acceptable use, your content, intellectual property, suspension and termination, complaints and our responsibility to you.

This guide summarises some important provisions but does not replace the full Terms. Please read the Terms carefully before creating an Account, starting a Free Trial or purchasing a Premium Membership.

1. About us and these Terms

1.1 These terms and conditions (“Terms”) govern your access to and use of The Little London Vegan website and web application (together, the “Platform”), and any content, features, services and benefits made available through the Platform, including any paid subscription entered into by you through the Platform (“Premium Membership”).

1.2 The Platform is operated by Macevery Limited (“we”, “us” and “our”), a company registered in England and Wales with company number 13086463. Our registered office is at Technology Centre, Unit 29, Epinal Way, Loughborough, Leicestershire, England, LE11 3GE.

1.3 You can contact us in relation to these Terms by emailing support@thelittlelondonvegan.com or by writing to our registered office address, although you acknowledge that correspondence sent by post may take longer to reach us and for us to respond.

1.4 These Terms apply whenever you access or use the Platform. Certain provisions apply only if you create an Account, start a free trial or purchase a Premium Membership, as indicated in the relevant provisions.

1.5 Please read these Terms carefully before using the Platform. Your access to and use of the Platform is subject to these Terms. By creating an Account, starting a free trial or purchasing a Premium Membership, you will be required to confirm that you accept these Terms. If you do not agree to these Terms, you are not permitted to access or use the Platform.

1.6 You should also read the following policies, which provide further information about the Platform and how we operate it:

(a) our Privacy Policy, which explains how we collect, use and otherwise process your personal information;

(b) our Cookies Policy, which explains how we use cookies and similar technologies;

(c) our Advertising, Affiliate and Editorial Disclosure Policy, which explains how we identify advertising, affiliate relationships, gifted experiences and other commercial relationships; and

(d) any other policies or guidance which we make available on the Platform from time to time and which are relevant to your use of the Platform or your Premium Membership.

1.7 The Platform is intended for use by individuals acting wholly or mainly outside their trade, business, craft or profession. You must not use the Platform for any business or commercial purpose.

2. Using the Platform

2.1 You may access certain content and features on the Platform without creating a registered user account (“Account”). Other content and features are available only if you create an Account, and some are available only if you also have an active Premium Membership. The Platform will identify when an Account or Premium Membership is required in order to access certain content and features.

2.2 To use the Platform, you must have access to a compatible device, a supported web browser and an internet connection. The Platform may not operate correctly on all devices, operating systems or browsers, and we do not guarantee that it will be compatible with any particular device, operating system or browser.

2.3 The Platform is provided as a web application and may be saved to the home screen of a compatible device as a web app. The Platform is not presently distributed through an app store. An internet connection is required to access and use certain features, including signing in to your Account, accessing information about your Premium Membership, saving content and redeeming Third-Party Offers. We do not guarantee that any part of the Platform will be available or operate offline.

2.4 You are responsible for providing and maintaining the devices, software, internet connection and other equipment required to access and use the Platform. You are also responsible for any charges imposed by your internet, mobile network or other service provider in connection with your use of the Platform.

2.5 We may update the Platform from time to time to improve its functionality, reflect changes to our services, address security issues or comply with legal or regulatory requirements. You may need to refresh the Platform, update your browser or operating system, or take other reasonable steps in order to continue using some features.

2.6 We do not guarantee that the Platform, or any particular content or feature, will always be available or uninterrupted. We may temporarily restrict or suspend access to all or part of the Platform where reasonably necessary for maintenance, updates, security, technical reasons or matters outside our reasonable control. Where reasonably practicable, we will try to give you advance notice of any material planned interruption.

3. Your Account

3.1 To create an Account, you must provide the information requested during the registration process. You must ensure that all information you provide is accurate, complete and not misleading, and must promptly update it if it changes.

3.2 Your Account is personal to you. This means that you must not:

(a) create an Account using another person’s identity or information;

(b) allow another person to access or use your Account;

(c) disclose or share your sign-in details with another person;

(d) transfer your Account to another person; or

(e) create or use more than one Account to obtain more than one free trial or otherwise avoid any restriction which applies to the Platform, your Account or a Premium Membership.

3.3 You must keep your sign-in details secure and confidential and take reasonable steps to prevent unauthorised access to your Account, including by using a strong and unique password and signing out of your Account where you use a shared or public device.

3.4 You must notify us promptly using the contact details set out in clause 1.3 if you know or suspect that:

(a) another person knows or has used your sign-in details;

(b) your Account has been accessed or used without your permission; or

(c) the security of your Account has otherwise been compromised.

3.5 If we reasonably believe that the security of your Account or the Platform has been compromised or is at risk, we may:

(a) require you to change your sign-in details or take other reasonable security measures; and

(b) temporarily restrict access to your Account while we investigate and address the relevant security issue.

We will restore access to your Account as soon as reasonably practicable once the relevant security issue has been resolved.

3.6 You are responsible for activity carried out through your Account unless it:

(a) results from our failure to take reasonable steps to keep the Platform secure; or

(b) occurs after you have notified us in accordance with clause 3.4 and we have had a reasonable opportunity to take appropriate action.

3.7 You must be at least 18 years old to create an Account. By creating an Account, you confirm that you meet this minimum age requirement and have the legal capacity to enter into a contract with us.

4. Premium Membership

4.1 A Premium Membership gives you access to the content, features and benefits identified as being available to premium members on the Platform (together, the “Premium Features”). Premium Features may include:

(a) enhanced search and filtering functionality;

(b) saved lists and planning tools;

(c) member-only guides and content; and

(d) access to discount codes, promotional offers and other benefits made available by restaurants, venues, brands and other independent third parties (together, “Third-Party Offers”).

4.2 The Premium Features available to you will be those identified on the Platform when you start your Premium Membership. The Platform will contain up-to-date details of the Premium Features and any requirements, restrictions or conditions which apply to them.

4.3 The availability and content of individual Premium Features may change from time to time. In particular, Third-Party Offers are made available by independent third parties and may be changed, suspended, withdrawn or subject to availability and additional conditions. We do not control those third parties or guarantee that any particular Third-Party Offer will remain available or be accepted or honoured in every circumstance. You should check the applicable conditions and, where appropriate, confirm availability with the relevant third party before booking, ordering, purchasing or travelling.

4.4 If we make a change which materially reduces the overall benefit of your Premium Membership during a period for which you have already paid (for example, by removing a material Premium Feature without replacing it with a substantially equivalent feature), we will notify you and, where appropriate, allow you to cancel your Premium Membership and receive a proportionate refund for the unused part of that period. The change, suspension or withdrawal of an individual Third-Party Offer by an independent third party will not, by itself, constitute a material reduction in the overall benefit of your Premium Membership.

4.5 You must have an Account to start and maintain a Premium Membership. Your Premium Membership is personal to you and must not be shared with or transferred to another person.

4.6 We offer monthly and annual Premium Membership plans. The price, billing period and Premium Features included in your chosen plan will be displayed on the Platform before you start your Premium Membership. Unless stated otherwise, all prices include VAT and any other applicable taxes.

4.7 To purchase a Premium Membership, you must complete the subscription process through the checkout facility on the Platform (“Checkout”). Before completing Checkout, you will be asked to confirm that you accept these Terms and will be shown the key details of your chosen Premium Membership, including its price, billing period, any applicable Free Trial and when payment will be taken.

4.8 By completing Checkout, you are making an offer to purchase a Premium Membership on these Terms. Your contract with us will begin when we confirm that your Premium Membership has started or, if earlier, when we make the Premium Features available to you. We will send confirmation to the email address associated with your Account.

4.9 Your Premium Membership will renew automatically at the end of each monthly or annual billing period for a further period of the same length, unless you cancel it or it is otherwise ended in accordance with these Terms.

4.10 If you have an annual Premium Membership, we will send you a reminder before it renews, explaining when the renewal payment will be taken, the amount of that payment and how you may cancel your Premium Membership.

5. Free Trials

5.1 We may offer eligible new members a free trial of Premium Membership for the period shown at Checkout (“Free Trial”). Unless otherwise stated at Checkout, the Free Trial period is seven days.

5.2 A Free Trial is available only once per person. You will not be eligible for another Free Trial if you have previously started or used one, whether through the same or a different Account. We may use information reasonably available to us to determine your eligibility for a Free Trial.

5.3 When starting a Free Trial, you must select the monthly or annual Premium Membership plan which you wish to begin when the Free Trial ends and provide a valid payment method.

5.4 A Free Trial gives you access only to those Premium Features identified as being available during the Free Trial. Third-Party Offers are a key benefit of paid Premium Membership and may provide valuable discounts and other benefits. For that reason, they are reserved for paying members and are not available during a Free Trial. This means that you will not be able to access any discount code, redemption code, barcode, voucher or other information or functionality required to claim or redeem a Third-Party Offer during your Free Trial, although you may be able to view general information about the Third-Party Offers which may become available if your Free Trial converts into a paid Premium Membership.

5.5 Unless you cancel before the Free Trial ends or choose to end your Free Trial early, your selected paid Premium Membership will begin automatically when the Free Trial ends and we will take the payment shown to you at Checkout. You may choose to end your Free Trial early and start your paid Premium Membership immediately. Before doing so, we will tell you the payment which will be taken and ask you to confirm that you wish to end the remainder of your Free Trial and begin paid Premium Membership. You will then receive access to the Premium Features included in your chosen plan, including Third-Party Offers.

5.6 We will send you a reminder before your Free Trial ends, explaining when your paid Premium Membership will begin, the amount which will be charged and how you may cancel.

5.7 You may cancel your Free Trial at any time before it ends using the cancellation method identified on the Platform. If you do so, you will not be charged and your access to the Premium Features available during the Free Trial will end at the end of the Free Trial period.

5.8 We may refuse or end a Free Trial if we reasonably believe that you are not eligible for it, have attempted to obtain more than one Free Trial, have provided false or misleading information, or have otherwise misused the Free Trial.

6. Payment

6.1 You must provide a valid payment method when you start a Premium Membership or Free Trial. By providing a payment method, you authorise us to charge it for the following payments, unless you cancel your Free Trial or Premium Membership before the relevant payment becomes due:

(a) the first payment due when your Premium Membership begins or, where applicable, when your Free Trial converts into a paid Premium Membership; and

(b) each subsequent payment due when your Premium Membership renews.

6.2 Payments are processed on our behalf by Stripe or any replacement payment provider identified at Checkout. Your bank or payment provider may require you to complete additional security or authentication checks before processing a payment.

6.3 You must ensure that the payment and billing information associated with your Premium Membership remains accurate and up to date and that you are authorised to use the payment method provided.

6.4 If we are unable to take a payment when it becomes due, we may:

(a) ask you to provide or update your payment details;

(b) attempt to take the payment again; and

(c) temporarily suspend your access to some or all Premium Features until the outstanding payment is made.

6.5 If an outstanding payment is not made on the due date for payment, we may end your Premium Membership by giving you notice. Ending your Premium Membership because of a failed payment will not, by itself, delete your Account or any content saved to it.

6.6 We may change the price of a Premium Membership from time to time. A price change will not affect any billing period for which you have already paid. We will give you at least 30 days’ notice before a price change applies to you. If you do not wish to pay the new price, you may cancel your Premium Membership before the change takes effect, in which case your Premium Membership will end at the end of your then-current billing period.

6.7 If you believe that we have charged you incorrectly, please contact us using the details in clause 1.3 so that we can investigate.

6.8 All payments will be charged in pounds sterling. If your payment method is denominated in another currency, your bank or payment provider may apply its own exchange rate or fees. We are not responsible for any exchange rate or fee applied by your bank or payment provider.

7. Your “cooling-off” rights

7.1 You have a legal right to cancel your Premium Membership during each of the following periods:

(a) the period of 14 days beginning on the day after your contract for Premium Membership is entered into in accordance with clause 4.8;

(b) where your Free Trial converts into a paid Premium Membership, the period of 14 days beginning on the day after the paid Premium Membership starts; and

(c) where an annual Premium Membership renews for a further annual period, the period of 14 days beginning on the day after the renewed period starts.

Each period described above is referred to in these Terms as a “Cooling-off Period”.

7.2 The information in this clause explains how the Cooling-off Periods operate and how you may exercise your right to cancel during them.

7.3 You may exercise your right to cancel during a Cooling-off Period without giving a reason by clearly informing us of your decision before the relevant Cooling-off Period ends. To exercise this right and request any applicable refund, you must contact us using the details in clause 1.3 or send us the model cancellation form set out at the end of these Terms. You do not have to use the model cancellation form, but your communication must make clear that you wish to cancel during a Cooling-off Period.

7.4 Your cancellation will be effective when you send or submit it, provided that you do so before the relevant Cooling-off Period ends. If you cancel by email or post, you should retain evidence showing when your cancellation was sent.

7.5 When completing Checkout, you will be asked to expressly request that we make the applicable Premium Features available to you during the Cooling-off Period described in clause 7.1(a). Where your Free Trial converts into a paid Premium Membership or your annual Premium Membership renews, the applicable Premium Features, including Third-Party Offers, may continue or become available during the relevant Cooling-off Period.

7.6 If you cancel during a Cooling-off Period, your Premium Membership will end, you must stop accessing and using the Premium Features and Third-Party Offers, and we will refund the relevant payment made by you less any amount which we are entitled by law to retain or recover for the Premium Features supplied before you cancelled.

7.7 Any amount which we retain or recover will be limited to the amount permitted by law and will be proportionate to the Premium Features supplied before cancellation, assessed by reference to the basis on which those Premium Features were agreed to be supplied and the relevant payment for them. If you have expressly requested immediate supply and have used paid Premium Features, including by redeeming a Third-Party Offer, you should not expect to receive a full refund because you will already have received part of the paid membership benefit.

7.8 Where you cancel an annual Premium Membership during a Cooling-off Period, you will not be required to pay the full annual Membership fee merely because Premium Features were made available to or used by you during that period. We will retain or recover only the amount which we are permitted by law to charge for the supply made before cancellation and will refund the balance.

7.9 We will make any refund due under this clause without undue delay and within 14 days beginning with the day on which you inform us of your decision to cancel. Unless you expressly agree otherwise, we will use the same payment method which you used to make the relevant payment and will not charge you a fee for the refund.

7.10 Cancelling your Premium Membership under this clause will not close your Account. You may continue to use any features available to Account holders without a Premium Membership unless your Account is separately closed in accordance with these Terms.

7.11 Nothing in this clause limits any other right or remedy available to you under these Terms or applicable law.

8. Third-Party Offers

8.1 Third-Party Offers are discounts, promotional offers and other benefits made available by restaurants, venues, brands and other independent third parties (each an “Offer Provider”). Each Third-Party Offer will identify the relevant Offer Provider and the requirements, restrictions and conditions which apply to it.

8.2 Before accessing or using a Third-Party Offer, you must check its applicable conditions. These may include participating locations, availability, expiry dates, excluded dates or times, booking or ordering requirements, minimum spend, usage limits and restrictions on combining it with other discounts or promotions.

8.3 You are responsible for ensuring that you satisfy the applicable conditions. Where appropriate, you should confirm the current availability directly with the Offer Provider before making a booking, placing an order, making a purchase or travelling to use it.

8.4 An Offer Provider may change, suspend or withdraw a Third-Party Offer at any time. An offer described as “ongoing” or as having “no fixed end date” remains available only for so long as the Offer Provider continues to make it available. We do not control Offer Providers and cannot guarantee that a particular Third-Party Offer, booking, product or service will remain available or that an Offer Provider will accept or honour it in every circumstance.

8.5 We will take reasonable steps to update the Platform after we become aware that a Third-Party Offer has changed, been suspended or been withdrawn, but there may be a delay before the information is updated.

8.6 Where a Third-Party Offer must be accessed or redeemed through the Platform, you must follow the applicable instructions. Accessing or unlocking an offer does not, by itself, constitute redemption unless those instructions state otherwise. You must not activate an in-person redemption until you are at the relevant location and an authorised member of the Offer Provider’s staff is ready to process it. Once confirmed, redemption cannot be reversed through the Platform. Screenshots, copies and other reproductions are not valid unless expressly permitted.

8.7 Third-Party Offers are personal to you and must not be copied, transferred, sold, shared or otherwise made available to another person. You must not attempt to redeem an offer more frequently than permitted, manipulate the redemption process or provide false or misleading evidence of entitlement.

8.8 The Offer Provider is responsible for deciding whether the applicable conditions have been met, providing the discount or other benefit and supplying any underlying goods or services. Any booking, order or purchase is a separate contract between you and the Offer Provider. We are not a party to that contract.

8.9 Offer Providers are independent from us. Nothing in these Terms creates a partnership, joint venture, agency, employment or other representative relationship between us and an Offer Provider.

8.10 If an Offer Provider refuses an offer which you reasonably believe you were entitled to use, or information which we published was materially inaccurate, please contact us using the details in clause 1.3 as soon as reasonably practicable and provide the information reasonably required to investigate. We will investigate and, where appropriate, seek clarification from the Offer Provider. If information which we published was materially inaccurate, we will take reasonable steps to correct it. We are not responsible for an Offer Provider’s independent decision to change, suspend, withdraw, refuse or cease honouring a Third-Party Offer.

9. Cancelling your Premium Membership

9.1 In addition to your rights to cancel during a Cooling-off Period, you may cancel your Premium Membership at any time using the cancellation facility made available through the Platform or by contacting us using the details in clause 1.3.

9.2 Unless clause 7 applies or we expressly agree otherwise, cancellation will take effect at the end of your current monthly or annual billing period. You may continue to access the applicable Premium Features until then, and your Premium Membership will not renew.

9.3 We will acknowledge your cancellation and confirm when your Premium Membership and access to the Premium Features will end.

9.4 Cancellation under this clause does not entitle you to a refund for any unused part of a billing period. This does not affect any right to a refund or other remedy which you have under clause 7, elsewhere in these Terms or by law.

9.5 Cancelling your Premium Membership will not close your Account. When the Premium Membership ends, you will lose access to Premium Features but may continue to use features available to Account holders without a Premium Membership.

10. Closing your Account

10.1 You may ask us to close your Account at any time using any account-closure facility made available on the Platform or by contacting us using the details in clause 1.3.

10.2 If you have an active Premium Membership, you must cancel its future renewal before you can close your Account. Cancelling your Premium Membership will not close your Account, and you may continue to access the applicable Premium Features until the end of your current Free Trial or paid billing period unless you subsequently choose to close your Account.

10.3 If you choose to close your Account after cancelling future renewal of your Premium Membership, closure will take effect immediately. You will lose access to your Account, saved content and any remaining Premium Features, including any access which would otherwise have continued until the end of your Free Trial or paid billing period. Before completing closure, you will be asked to confirm that you understand these consequences. Closing your Account does not, by itself, entitle you to a refund for any unused part of a paid billing period, except where these Terms or the law provide otherwise.

10.4 Closing your Account may result in deletion of saved lists, plans, preferences and other content associated with it. You should retain any information which you wish to keep before closure. We may retain information where required or permitted by law, as explained in our Privacy Policy.

11. Shared plans and your content

11.1 You retain ownership of text and other content which you add to lists, plans or other Account features (“Your Content”).

11.2 You grant us a non-exclusive, worldwide and royalty-free licence to host, store, copy, reproduce, process, transmit, display and make technical adaptations to Your Content to the extent reasonably necessary to:

(a) operate, maintain and secure the Platform;

(b) provide the relevant Account features and make any shared plan available in accordance with your instructions;

(c) investigate and resolve technical issues; and

(d) analyse, improve and develop the Platform and its features.

11.3 We may allow our service providers to exercise the rights granted under clause 11.2 on our behalf only to the extent reasonably necessary for the purposes described in that clause.

11.4 The licence in clause 11.2 ends when Your Content is deleted or your Account is closed, except that:

(a) copies may remain temporarily in routine backups and may be retained by us or our service providers where required or permitted by law; and

(b) we may continue to use improvements, developments, analyses and insights generated from Your Content, provided that they do not identify you, reproduce Your Content or enable Your Content to be extracted or reconstructed.

11.5 Anyone who receives a shared-plan link may be able to view it and forward the link to others. You are responsible for deciding what to include and must not include another person’s personal information unless you are entitled to do so.

11.6 You must ensure that Your Content complies with clause 12 and does not infringe another person’s rights. You confirm that you have all rights and permissions needed to provide Your Content and grant the licence in clause 11.2.

11.7 You may delete Your Content using the functionality made available on the Platform. Where you have shared a plan, deleting the original plan will not necessarily delete any separate shared snapshot or disable the link through which it has been shared. If you would like a shared snapshot to be removed or its sharing link disabled, please contact us using the details in clause 1.3. We may remove or disable access to Your Content where we reasonably believe that it breaches these Terms or the law.

11.8 If you believe that shared content is unlawful, infringes your rights or otherwise breaches these Terms, please report it using the details in clause 1.3.

12. Acceptable use

12.1 You must use the Platform only for lawful, personal and non-commercial purposes and in accordance with these Terms.

12.2 You must not:

(a) use the Platform in any unlawful, fraudulent, abusive or misleading manner;

(b) impersonate another person, misrepresent your identity or provide false information;

(c) forge, alter or misuse receipts, redemption confirmations, discount codes or other evidence relating to a Third-Party Offer;

(d) introduce viruses, malicious code or other harmful material, or interfere with the security, integrity, availability or operation of the Platform;

(e) attempt to gain unauthorised access to the Platform, an Account, our systems or data;

(f) circumvent any access, eligibility, payment, usage or redemption restriction;

(g) use bots, scrapers, crawlers or other automated means to access, monitor, copy or extract data from the Platform;

(h) use the Platform or its content to train, test or develop an artificial intelligence or machine-learning system without our written permission;

(i) submit, share or transmit content which is unlawful, defamatory, threatening, discriminatory, obscene, infringing, misleading or otherwise harmful; or

(j) encourage, assist or permit another person to do any of the above.

12.3 You must not use the Platform in a way which imposes an unreasonable load on it, disrupts another person’s use or may damage our reputation or that of an Offer Provider.

12.4 We may investigate suspected misuse and take the protective or enforcement action described in clause 16.

13. Our content and intellectual property rights

13.1 The Platform and its content belong to us or our licensors and are protected by copyright, database rights, trade marks and other intellectual property rights. This includes reviews, guides, photographs, venue information, curated lists, design, software, code, branding and the selection and arrangement of content.

13.2 We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Platform for your own non-commercial purposes in accordance with these Terms.

13.3 Except where permitted by law or with our prior written permission, you must not copy, reproduce, modify, adapt, translate, distribute, republish, sell, license, create derivative works from, commercially exploit or otherwise use any part of the Platform or its content.

13.4 You must not remove or alter any copyright, trade mark or other proprietary notice appearing on the Platform.

13.5 Third-party maps, place information and other third-party content may be subject to additional terms identified on or through the Platform. Your use of that content is also subject to those terms.

14. Reviews, information and third-party services

14.1 Reviews, ratings and recommendations express opinions based on visits, experiences or information available when they were prepared. They are provided for general information and do not guarantee that you will have the same experience.

14.2 Venue details, menus, ingredients, prices, opening hours, ownership, accessibility information and availability may change. You should check information which is important to you directly with the relevant venue before booking, ordering, purchasing or travelling.

14.3 Dietary descriptions and tags, including “vegan”, “vegetarian” and “gluten-free”, reflect information supplied by venues or available to us at the relevant time. They are not allergen-safety guarantees. If you have an allergy, intolerance or other dietary requirement, you must discuss it directly with the venue before ordering or consuming anything.

14.4 The Platform may contain links to third-party websites, services or booking facilities. We do not control them and are not responsible for their availability, content, security or privacy practices. Your use of them is subject to the relevant third party’s terms.

14.5 Any booking, order or purchase made with a third party is a separate contract between you and that third party. We are not responsible for the goods or services supplied under that contract.

14.6 Commercial relationships between us and third parties are identified in accordance with our Advertising, Affiliate and Editorial Disclosure Policy.

15. Our responsibility to you

15.1 Nothing in these Terms affects your statutory rights. When considering the scope of the Platform, Premium Features and other matters which we have agreed to provide, please also refer to:

(a) the description of Premium Membership and Premium Features in clause 4;

(b) the provisions concerning Third-Party Offers and Offer Providers in clause 8; and

(c) the provisions concerning reviews, venue information and third-party services in clause 14.

15.2 We are responsible for loss or damage which you suffer as a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or, when the contract was made, both you and we knew that it might happen.

15.3 We are not responsible for loss or damage which is not foreseeable, results from information which you failed to check as required by these Terms, or is caused by an Offer Provider or another third party acting independently from us, except where the law makes us responsible.

15.4 We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and breach of your statutory rights for which our liability is not capable of being excluded or limited.

15.5 The Platform is provided for personal use. We are not responsible for business losses, including loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data, arising from unauthorised business or commercial use.

16. Suspension and termination

16.1 We may suspend access to all or part of the Platform, your Account, Premium Features or access to Third-Party Offers through the Platform immediately where reasonably necessary to protect you, us, an Offer Provider or another person; investigate suspected fraud, misuse or a security incident; prevent unlawful activity; comply with law or a regulator’s requirement; address a payment failure; or respond to an emergency.

16.2 We may suspend or end your Account or Premium Membership if you:

(a) seriously or repeatedly breach these Terms;

(b) fail to remedy a breach within a reasonable period after we ask you to do so;

(c) use or attempt to use the Platform, a Free Trial or a Third-Party Offer fraudulently or dishonestly;

(d) provide false or misleading information, impersonate another person or compromise the security of the Platform;

(e) fail to pay an amount due to us by the due date for payment; or

(f) engage in conduct which we reasonably believe is unlawful, harmful or likely to expose us or another person to material risk.

16.3 Where a breach is capable of remedy and there is no urgent risk, we will normally give you notice of the breach and a reasonable opportunity to remedy it before ending your Account or Premium Membership.

16.4 We may suspend or terminate immediately, without prior notice, where the breach is serious or incapable of remedy, fraud or deliberate misuse is suspected, urgent action is required to protect security or prevent harm, or giving notice would be unlawful or materially prejudice an investigation.

16.5 Where reasonably practicable and lawful, we will tell you the reason for a suspension or termination and, where appropriate, allow you to provide information which may be relevant to our decision. We may withhold details where disclosure could compromise security, prevention of fraud, another person’s rights or a legal obligation.

16.6 A suspension may remain in place for as long as reasonably necessary to investigate and address the relevant matter. We will restore access when the reason for suspension has been resolved, unless we are entitled to terminate.

16.7 If we end your Premium Membership because of your breach, misuse or non-payment, we will provide any refund required by law but may refuse a discretionary refund.

16.8 We may discontinue all or a material part of the Platform or cease offering Premium Membership by giving you reasonable notice. Where practicable, we will give at least 30 days’ notice, although a shorter period may be necessary for legal, regulatory, security or other urgent reasons outside our reasonable control. If discontinuance ends a paid Premium Membership before the end of a paid billing period, we will provide a proportionate refund for the unused period.

16.9 When your Account is closed or your Premium Membership ends:

(a) your right to access the affected features ends;

(b) you must stop using Third-Party Offers and any codes or redemption information obtained through the ended Premium Membership;

(c) we may disable or delete Your Content and Account data in accordance with clauses 10 and 11 and our Privacy Policy; and

(d) any provision which by its nature is intended to continue will remain in force, including provisions concerning intellectual property, accrued payment obligations, liability, disputes and general terms.

17. Events outside our control

17.1 We are not responsible for any delay or failure to perform our obligations under these Terms which is caused by an event outside our reasonable control. Such events may include failures of internet, telecommunications, hosting, cloud, mapping or payment services; cyberattacks; power failures; industrial disputes; natural disasters; epidemics or pandemics; acts of government; civil emergencies; acts or failures of third parties on whom we reasonably rely which are outside our reasonable control; and changes in law which prevent or delay performance.

17.2 If an event outside our reasonable control affects the Platform or Premium Membership, we will take reasonable steps to minimise its effect and resume performance as soon as reasonably practicable. If an event outside our reasonable control prevents us from providing all or a material part of the paid Premium Features for a prolonged period, you may cancel your Premium Membership. We will provide any refund required by law and, where cancellation takes effect before the end of a paid billing period because the affected Premium Features cannot reasonably be restored, a proportionate refund for the unused part of that period.

18. Changes to these Terms

18.1 We may change these Terms to reflect changes in law, regulation, guidance, technology, security, the Platform, our business or the way in which we provide Premium Membership.

18.2 If a change is minor, administrative or does not materially disadvantage you, it may take effect when the updated Terms are published on the Platform.

18.3 If a change materially affects your Premium Membership or your rights during a paid billing period, we will give you reasonable advance notice, normally at least 30 days, unless a shorter period is required for legal, regulatory or urgent security reasons.

18.4 If you do not agree to a material change, you may cancel your Premium Membership before it takes effect. Where the change materially disadvantages you during a period for which you have already paid, we will provide any proportionate refund required by these Terms or law.

18.5 Price changes are dealt with in clause 6.6. Changes to individual Third-Party Offers are dealt with in clause 8, as summarised in clause 4.3.

19. Complaints and disputes

19.1 If you have a complaint in connection with your Account or Premium Membership, please contact us using the details in clause 1.3 and provide your name, the email address associated with your Account, a description of the issue and the outcome you are seeking.

19.2 We will acknowledge your complaint within a reasonable time, investigate it fairly and keep you informed where the investigation is likely to take longer than expected.

19.3 If your complaint concerns an Offer Provider or Third-Party Offer, we may ask for supporting information and seek clarification from the Offer Provider. We remain responsible only for matters for which these Terms or the law make us responsible. Our investigation will relate to the operation of the Platform and information which we published. We are not responsible for investigating the Offer Provider’s wider business or the goods or services which it supplies.

19.4 If we cannot resolve your complaint, we will provide any information about alternative dispute resolution which we are required by law to give. We are not obliged to participate in an alternative dispute resolution procedure unless we tell you otherwise or the law requires us to do so.

19.5 Nothing in this clause prevents you from bringing court proceedings or using another remedy available to you.

20. General

20.1 We may transfer our rights and obligations under these Terms to another organisation, for example as part of a sale, restructuring or transfer of the Platform. We will notify you if this happens. The transfer will not reduce your rights, and you may cancel if it materially disadvantages you.

20.2 You may not transfer your rights or obligations under these Terms or your Account or Premium Membership to another person without our written consent.

20.3 If we delay enforcing these Terms, we may still enforce them later. If we do not insist immediately that you do something required by these Terms, or take action in respect of a breach, that does not waive our rights.

20.4 Each provision of these Terms operates separately. If a court or relevant authority finds any provision unlawful or unenforceable, the remaining provisions will continue in effect.

20.5 These Terms are between you and us. No other person has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

20.6 These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the law of England and Wales.

20.7 You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you live elsewhere, you retain any mandatory consumer protection and right to bring proceedings which the law of your country of residence gives you.
